Disputes

– Any dispute, claim, or assertion in any way to your use of ABSBullion.com or to any products you purchase from ABSBullion.com will be resolved by binding arbitration, rather than court, except that you may assert claims in small claims court if your claim would qualify. You agree that the Federal Arbitration Act and the laws of the state of New York, without regard to principles of conflict of laws, will govern these terms and conditions.

– Any credit card chargeback will be subject to a minimum $50 processing fee. A processing fee may be charged to the credit card used to place the order or added to the user’s account balance at ABS Bullion’s discretion.

– Any bounced check payment will be subject to a minimum $35 processing fee. A processing fee may be charged to the credit card used to place the order or added to the user’s account balance at ABS Bullion’s discretion.

Terms Of Purchase

When an order is confirmed, prices become locked in, and the order becomes a contractually binding agreement between the “buyer” and ABS Bullion Inc. By placing an order through the ABS Bullion website or via telephone and agreeing to our terms and conditions, the customer enters into a contractually binding agreement with ABS Bullion Inc. The “buyer” agrees to send ABS Bullion Inc. payment as contractually specified at the time of order for PayPal, credit card, Stripe, e-check, and any other form of payment that may be accepted. Submitting an order through the website, or by phone requires the “buyer” to agree to our full terms of use, including the ABS Bullion Inc. order cancellation policy

ABS Bullion Inc. reserves the right in its sole discretion to allow the dissolution of the contractually binding agreement between the “buyer” and ABS Bullion Inc. by cancellation of your outstanding order. Order cancellations will incur any operational, hedging, and/or market loss fees. Any cancellation requests must be filed via telephone during normal business hours. ABS Bullion will evaluate any request to cancel an order on a case-by-case basis, and only under extraordinary circumstances will a cancellation be approved.

Cancellation fees are calculated as 5% of the order total or $35, whichever is greater, plus any applicable market loss. A “market loss” is defined as the difference between the locked spot price of the metals at the time of the order and the spot price of the metals at the time of cancellation. The balance due to ABS Bullion is to be paid within ten (10) business days.

If we do not receive payment within this timeframe, ABS Bullion reserves the right to send customer accounts to “collections” to retrieve cancellation fees.

Any collection activities charged to ABS Bullion Inc. will be added to the balance due. Should the order enter legal proceedings, the amount owed would increase by 50%, and all attorney fees incurred would be the responsibility of the customer.

Any market gains as a result of a canceled order will remain the property of ABS Bullion.
Any order that remains unpaid outside of payment terms as described in ABS Bullion’s Payment Policies is eligible for cancellation.

ABS Bullion reserves the right to decline, refuse, or cancel any order with or without reason, regardless of payment method or order confirmation. ABS Bullion also reserves the right to cancel any order deemed questionable, suspicious, or too significant of a risk, or if payment has not been received within a specified time frame.

ABS Bullion provides the most accurate information available at any given time. Occasionally, mistakes occur, whether it may be a typographical or pricing error. Under these rare circumstances, ABS Bullion retains the right to cancel or refund an order. If a typographical, mathematical or other error is made in the calculation of a transaction, the customer agrees to take all steps requested by

ABS Bullion to rectify the error. The customer further agrees to hold ABS Bullion harmless from all damages or liability arising from such error. The customer must notify ABS Bullion in writing within 7 business days after receipt of material of any discrepancy, claim, or dispute arising from a transaction. If no notification is received within 7 business days, the customer agrees it is forever barred from bringing a claim for loss, damage, or other relief relating to such controversy, claim, or dispute.

Larger Order Policy—A large order is defined as an order equal to or greater than $20,000 USD. If you are looking to place an order of this size, please call and speak to a representative before placing the order. At ABS Bullion’s discretion, we may require a 10% – 20% deposit via bank wire transfer before locking in the price of a large order. Also, larger orders may only be placed via the phone during our business hours.

Guest Checkout—Please note that if you check out as a guest on our website (i.e., you do not log in to your account before placing the order), the order you checked out with as a guest will NOT show up under your customer account.
